Paying for Environmental Cases

The UK has finally recognised that access to environmental justice must not be prohibitively expensive and has made some steps to fulfilling that requirement.

By law, your exposure to costs in England and Wales, or expenses in Scotland – that is, how much you might need to pay the other side in any legal case – can now be limited in environmental cases to £5,000 for an individual or £10,000 for a group (such as an action group or local environmental charity).

You still have to pay your own costs or expenses, but Guy Linley-Adams will consider acting under a conditional fee agreement (previously known as “no win no fee”) or discounted conditional fee agreement, which give would-be claimants absolute security as to the maximum exposure to costs (both those you would pay to your own solicitor, as well as those to the other side in the event that any litigation was lost).
